建筑装饰工程施工合同Contract发包方（简称甲方）Party A:承包方（简称乙方）：上海巧点装饰设计有限公司Party B:i-point design(Inspiration Point Design)根据<中华人民共和国合同法><中华人民共和国消费者权益保护法><中华人民共和国价格法><上海市合同格式条款监督条例>，<上海市建筑市场管理条例>，以及其他有关法律法规规定的原则，结合本工程的具体情况，甲、乙双方在平等、自愿、协商一致的基础上达成如下协议，共同遵守According to:"PRC Contract Law","Law on the Protection of Consumer Interests","PRC Price Law","Shanghai Supervision ofContract Terms","Shanghai Construction Market Management Regulations",as well as other laws and regulations relevant tothe specific circumstances of this project,parties Aand B have hereby equally and voluntarily entered into the followingagreement executed on the basis of mutual respect.概况OVERVIEW1.甲方装饰物业系合法物业Party A is the owner of the property.2.乙方为本市经工商行政管理机关核准登记，并可从事装潢装修的企业Party B is approved and registered with the city industrial and commercial administrative organs as anenterprise engaged in renovation and decoration.装饰施工地点Construction site:4建筑结构：建筑面积平方米，施工面积平方米。Construction area:total area (including stairwells and other common areas):m2,private living area:5.装饰施工内容：住宅装饰，详见附件一<工程估价单>Structure:residential.承包方式：详见附件一<工程估价单>Contractor engagement method:See annex-(quotation).7.总价款：.00元，大写（人民币元整。Total price:00RMB:in words:元整.Any changes in this price SUPPLY OF MATERIALS1.乙方提供的材料：乙方供应的材料、设备如不符合设计、施工要求，应禁止使用。如已使用，对工程造成的损失由乙方负责。如甲方要另增加材料由甲方供应，并应符合下列规定：Material provided by Party B:Any materials or equipment supplied by Party B which do not meet the design andconstruction requirements are prohibited.Any extra materials requested by Party A which were not in the originaldesign must be paid for by Party A.2.甲方提供的材料：另拟补充附件<甲方提供材料、设备表>甲方负责采购供应的材料、设备，应符合设计施工要求的合格产品，并应按时供应到现场。乙方发现甲方提供的材料、设备有质量问题或规格差异，应及时向甲方提出，甲方仍要求使用的，由此造成工程损失，责任由甲方承担。甲方供应的材料按时抵达现场后，由乙方负责保管Material provided by Party A:(see the annex:"Table of Materials to be provided by the Owner").If Party Aacquires materials for the project,it should first check with Party B that the materials match to the designrequirements,and once the materials are in the care of Party B,then Party B is responsible for the materials.IfParty A requires some materials which do not fit to the design then it shall be the responsibility of Party A to payany additional costs incurred by Party B.四、关于工程质量及验收的约定FULFILMENT OF THIS AGREEMENT1.本工程应符合<建筑装饰工程技术规程>和市建设行政主管部门制定的其它地方标准质量评定验收标准The execution of this project must be consistent with the "Architectural and Engineering Rules"of the cityadministrative departments responsible for the development of buildings and local standards and qualityevaluation acceptance criteria.2.本工程由乙方进行设计，提供施工图纸一式两份，双方签字确认Party B must provide a duplicate copy of the construction designs and drawings,and both copies should be signedby both parties.3.甲方提供的材料，设备质量不合格而影响工程质量，其返工费用由甲方承担，工期相应倾延If materials provided by Party A for the construction do not meet the necessary requirements,Party A shall bearresponsibility for any resulting delays in the completion in the project.4.由于乙方原因造成质量事故，其返工费用由乙方承担If the quality of Party B's work results in any accidents,the liability for such accidents shall be the responsibility ofParty B.5.在施工过程中，甲方提出设计修改意见及增减工程项目，须提前与乙方联系，在双方签订<工程项目变更单>后，方能进行该项目的施工、因此影响工程竣工日期的，责任由甲方承担。凡甲方私自与施工人员商定更改施工内容、增加施工项目所引起的一切后果，甲方自负，给乙方造成损失的，甲方应予赔偿If,during the construction,Party A wishes to propose a change to the design,he should sign a "Change ofProject"with Party B and must assume responsibility for resulting delays or increase in costs.If Party A secretlyattempts to change to design directly with the construction personnel and this action causes loss to Party B,thenParty A must compensate Party B for this loss.6.工程验收：乙方负责理隐蔽工程和中间工程的检查与验收手续。由乙方组织专门人员进行验收。一切理隐蔽工程和中间工程的质量由乙方负责The standard of work.It is the responsibility of Party B to make sure that all construction works are carried out tothe requirements of the design and to make sure that all internal walls and hidden construction parts are to therequired standard.7.工程竣工：乙方完工后即应通知甲方验收，甲方应在竣工当日组织验收，并办理验收移交手续，双方签<工程质量验收单>。如果甲方在规定时间内不能组织验收，须及时通知乙方，另定验收日期。如通过竣工验收，甲方应承认原竣工日期，并承担因此造成的乙方的看管费用和其他相关费用Project completion.Party B must notify Party A when the project is complete and ready for inspection by Party A.After inspection both parties must sign an "Engineering Quality Acceptance"document.If Party A is not availableto inspect the construction site on the completion date,he must notify Party B of the soonest available date.Where Party A is not available on the completion date to retake custody of the location,he must pay any extracosts incurred by Party B.8.工程保修期一年。工程竣工验收后甲、乙双方签署<工程保修单>，凭保修单实行保修，保修期一年，从竣工验收签章之日起算One year warranty.After completion of the work and signing of the "Single Warranty",there shall be a one yearwarranty on the construction.五、有关安全生产和防火的约定SAFE PRODUCTION AND FIRE REGULATIONS1.施工图纸和施工说明应符合防火防事故的要求，主要包括电气线路等管道畅通、合格。乙方在施工中应采取必要的安全防护和消防措施，保障作业人员及相邻关系的安全，防止相邻单位的管道堵塞、渗漏水、停电、物品毁坏等事故发生Construction drawings and construction must be in line with fire prevention regulations,and accident preventionrequirements.This includes electrical circuits and pipelines.Party B shall take measures to ensure the safety ofworkers and neighbors at the constructions site and must prevent leakage of water,interruptions of power anddamage to property2.施工中凡涉及改变房屋结构，拆、改承重墙，加大楼（地）面荷载，由甲方向物业管理部门提出申请，经所在地建设行政主管部门批准后方能施工Any changes to the housing structure or demolition or alteration to load bearing walls or increase in floor loadmust first be approved by the building property management before construction begins.3.双方款项往来均应出具正规收据和发票，以备查验和结算Both parties must provide money exchange receipts and invoices.六、其它事项OTHER MATTERS1.甲方工作Party A1.甲方应在开工前确认施工图纸并腾出足够的施工空间，以清除彩响施工的障碍物。甲方向乙方提供施工需用的水、电等必备条件，并说明使用注意事项When Party A confirms the pre-construction and construction drawings,he must also make sure there issufficient space available at the construction site for construction to take place.Party A must make sure thatParty B has everything necessary on site for completion of the construction,particularly electricity and water.2.做好施工中因临时使用公用部位操作彩响邻里关系等的协调工作Party A must take care of the public relations in the construction site area-particularly with the neighbors.2.乙方工作Party B1.参加甲方召集的现场交底Party B must be available to attend meetings organized by Party A2.乙方按要求组织施工，保质、保量、按期完成施工任务Party B must follow the construction plans,and the construction must be durable,and must meet thescheduled completion date.七、违约责任LIABILITY FOR BREACH OF CONTRACT1.由于甲方原因导致延期开工或中途停工，工期顺延If Party A causes any delays to the completion of this project,then the scheduled completion date should beadjusted accordingly.2.由于乙方原因逾期竣工的，每逾期一天，乙方向甲方支付工程造价0.1%（大写：千分之一的违约金If Party B causes any delay to the completion of this project,then Party B must pay to Party Aa fee of 0.1%in words:1/1000)of the total overall project fee for each day beyond the scheduled completion date.3.甲方未办理有关手续，强行要求乙方拆改原有建筑承重结构及共用设备管线，由此发生的损失或事故（包括罚款）由甲方负责并承担责任If Party A instructs Party B to make any alterations to a load bearing wall and Party A has not sought and receivedpermission from the building property management,Party A shall be responsible for any resulting costs and shallindemnify Party B for any additional expenses incurred.4.乙方擅自拆改原有建筑承重结构或共用设备管线，由此发生的损失或事故（包括罚款），由乙方负责并承担责任If Party B makes any unauthorized changes to load bearing walls or building pipelines and such changes result indamages or loss,it shall be the responsibility of Party B to pay for such loss.5.工程未办理验收、结算手续，甲方提前使用或擅自动用工程成品由此造成无法验收和损失的，由甲方负责并承担责任Party A shall be responsible for any extra costs incurred due to his use of the property before the final completionmeeting and signing of the "Engineering Quality Acceptance"document.八、纠纷处理方式
